Terms of Service & Digital Content Agreement

1. Acceptance of Terms & Service Description
Welcome to BenchCert (“the Platform”). By creating an account, accessing practice simulations, or purchasing a pass on BenchCert, you agree to be bound by these Terms of Service. BenchCert provides interactive technical certification practice drills, timed mock exams, domain telemetry, AI Hints, and a Personalized AI Tutor.
2. EU Digital Content Waiver & No-Refund Policy (Directive 2011/83/EU)
IMPORTANT NOTICE FOR EUROPEAN UNION & SPANISH CONSUMERS:
Pursuant to Article 16(m) of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights and Article 103(m) of Spanish Royal Legislative Decree 1/2007 (TRLGDCU), the statutory 14-day right of withdrawal (cooling-off period) does not apply to contracts for the supply of digital content which is not supplied on a tangible medium once performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.
Because BenchCert grants immediate, full digital access to proprietary exam question banks, domain explanations, and Personalized AI Tutor features upon purchase activation:
- By completing a purchase of any digital pass (including the $3.99/mo Supporter Pass, $9.99/mo Pro Pass, or $39.99 Lifetime Founder Pass), you expressly consent to immediate digital delivery and acknowledge the waiver of your 14-day right of withdrawal.
- All digital passes and subscriptions are final and non-refundable once activated.
3. Non-Expiring Access & Acceptable Use Policy
Lifetime Founder Passes grant personal, non-transferable access to all certification tracks on the Platform for the operational lifetime of the Platform without arbitrary 90-day or 365-day expiration timers.
You agree not to engage in any of the following prohibited activities:
- Automated scraping, crawling, bulk harvesting, or redistribution of BenchCert's proprietary technical question bank or explanations.
- Sharing account credentials across multiple individuals or reselling access to third parties.
- Attempting to bypass authentication gates, abuse Personalized AI Tutor rate limits, or probe platform infrastructure.
4. Intellectual Property & Independent Trademark Disclaimer
BenchCert is an independent educational engineering platform. All original scenario questions, distractors, and diagnostic rubrics are original educational works authored for active-recall study.

BenchCert is neither affiliated with, sponsored by, nor endorsed by Amazon Web Services or CompTIA. Official certification badges displayed on the Platform are used strictly for nominative fair-use identification of the respective certification tracks.
5. Educational Disclaimers & Limitation of Liability
BenchCert provides technical study simulations and AI-assisted study hints on an “AS IS” and “AS AVAILABLE” basis. While our scenarios are calibrated to official exam blueprint domains, completing practice drills on BenchCert does not guarantee passing any official third-party certification exam.
To the maximum extent permitted by applicable EU and Spanish law, BenchCert shall not be liable for indirect, incidental, or consequential damages, including official exam registration fees or lost certification opportunities.
6. Governing Law, Support & Dispute Resolution
These Terms of Service are governed by the laws of the Kingdom of Spain and applicable regulations of the European Union, without prejudice to mandatory consumer protection rights applicable in your EU Member State of residence. For billing or account assistance, contact benchcertsupport@gmail.com.
